Arazi ve arsa düzenlemesi uygulamalarında bedele dönüştürme: Bedelin tahsili ve ödenmesi süreci

Abstract

Türk mevzuatında Arazi ve Arsa Düzenlemesi (AAD)’nin yasal dayanağı olan 3194 sayılı İmar Kanunu’nda 2019 yılında önemli değişiklikler yapılmıştır. Yapılan değişikliklerden birisi ise daha önce isteğe bağlı olarak gerçekleştirilen bedele dönüştürme uygulamalarının re’sen yapılabilir hale gelmesidir. Yapılan değişiklikler ile mevzuatta bedele dönüştürmeye ilişkin önemli hükümlere yer verilmiştir. Ancak bedele dönüştürmenin nasıl uygulanacağı ile ilgili belirsizlikler bulunmaktadır. Bu çalışma ile AAD’de hukuki ve fiili imkansızlıklar nedeniyle alınamayan Düzenleme Ortaklık Payı (DOP)’nın bedele dönüştürülmesi uygulamalarında tespit edilen bedele dönüştürme miktarının nasıl değerlendirilmesi gerektiği irdelenmiş ve bedelin tespitine ilişkin yöntem önerisinde bulunulmuştur. Ayrıca tespit edilen bedelin nasıl tahsil edileceği, hak sahiplerine nasıl ödeneceğine ilişkin mevzuatta yer alan hükümler doğrultusunda yöntem geliştirilmiştir. Yönteme ilişkin iş adımları, iş akış diyagramları ile sunulmuştur. Ayrıca bir örnek uygulama alanında önerilen yönteme ilişkin işlemler açıklanmıştır. Örnek uygulama ile uygulayıcıların kullanabileceği klişeler geliştirilmiştir.

Significant changes were made to the Zoning Law No. 3194, which is the legal basis of Land Readjustment (LR) in Turkish Legislation, in 2019. One of the changes made is that the conversion the additional development readjustment shares to price, which were previously carried out optionally, can now be carried out ex officio. With the changes made, important provisions regarding the conversion the additional development readjustment shares to price have been included in the legislation. However, there are uncertainties regarding how the conversion to price will be implemented. This study examines how the conversion amount determined in the implementations of converting the Development Readjustment Shares (DRS) into price, which cannot be obtained in the LR, will be evaluated. In addition, a method for determining the price was suggested. In addition, a method has been developed in line with the provisions in the legislation regarding how the determined amount will be collected and how it will be paid to the rightful owners. The work steps related to the method are presented with workflow diagrams. Moreover, the procedures for the proposed method are explained in an example implementation area. Clichés that practitioners can use have been developed with the sample implementation.
