İnşaat projelerinde süre uzatımının hukuki ve mühendislik açılardan incelenmesi

Abstract

İnşaat sözleşmelerinde genel itibariyle, yüklenicinin taahhüt ettiği edimi yerine getirmesi için bir süre belirlenmektedir. Belirlenen inşaat süresi uzadıkça, işin tamamlanamama ihtimali de artmaktadır. Ülkemizde de inşaat projelerinin sıklıkla vadesinde bitmediği, bu durumda yüklenicilerin cezalı şekilde çalıştığı ya da sözleşmenin feshi ile karşı karşıya kalındığı bilinmektedir. En sıradan bakım-onarım işlerinden, daha karmaşık ve uzmanlık gerektiren hastane, okul, altyapı işlerine kadar her türden projenin teslim süresi hususunda yüklenici firma ile sorunlar yaşanabilmektedir. Bu noktada gecikmeye neden olan etkenlerin ortaya konulması önem kazanmaktadır. Çünkü bu şekilde yüklenici temerrüde düşebileceği gibi işin bitirilmesi için süre uzatımı hakkı da kazanabilmektedir. Süre uzatımına ilişkin talepler çoğu zaman taraflar arasında anlaşmazlıklar yaratmakta, bu durum hukuki süreçlerin uzamasına ve projenin aksamasına neden olmaktadır. Bu çalışmada özel sektörde 6098 Sayılı Türk Borçlar Kanunu hükümlerine tabi şekilde imzalanan inşaat sözleşmelerinde süre uzatımı kavramı ele alınmaktadır. Bu amaçla, ilgili mevzuatlar incelenmiş, sözleşme taraflarının sorumlulukları ve süre uzatımının koşulları ile hesabına yönelik hem hukuki hem de mühendislik çözümlerine yer verilmiştir. Ayrıca inşaat işlerinde uygulanan iş programı ve gecikme analizleri aracılığıyla süre uzatımı değerlendirilmiştir.

In construction contracts, a specific due date is generally set for the contractor to fulfill the obligations they have committed to. As the construction period extends, the likelihood of the project not being completed increases. It is well-known that in our country, construction projects frequently fail to be completed on time, which often results in contractors working under penalties or facing contract termination. The problems can arise regarding the completion time of all types of projects, ranging from the routine maintenance and repair tasks to more complex and specialized projects such as hospitals, schools, and infrastructure works. At this point, it becomes crucial to identify the factors causing the delays since the contractor may fall into default or, alternatively, gain the right of a time extension for completing the work. The requests for time extensions frequently lead to disputes between the parties, prolonging legal processes and causing project delays. In this study, the concept of time extension in construction contracts signed in the private sector under the provisions of the Turkish Code of Obligations No. 6098 is examined. For this purpose, relevant laws have been reviewed, and both legal and engineering solutions are provided concerning the responsibilities of the contracting parties, the conditions for time extension, and how it is calculated. Additionally, time extension is evaluated through project schedules and delay analyses used in construction projects.
