Tutuklama – mahsup – erteleme müesseselerinin birlikte uygulanma hâlleri üzerine bir inceleme

Abstract

Mahsup, kesin hükümden önce gerçekleşen hürriyeti kısıtlayıcı sürelerin, hükmolunan cezadan indirilmesidir. Tutuklama, hürriyeti kısıtlayıcı özelliği nedeniyle mahsuba neden olan bir koruma tedbiridir. 5237 numaralı Türk Ceza Kanunu’nda, hapis cezasının ertelenmesi, cezanın özel bir infaz biçimi olarak düzenlenmiştir. Buna göre hapis cezasının ertelenmesi kararı ile birlikte, hükmolunan hapis cezası toplum içerisinde infaz edilmektedir. Bu nedenle tutuklama, mahsup ve erteleme müesseselerinin birlikte uygulanma hâlleri, çözülmesi gereken önemli bir mesele olarak ortaya çıkmaktadır. Çünkü hapis cezasının ertelenmesi kararı ile birlikte, hükmolunan hapis cezası toplum içerisinde infaz edildiği hâlde, mahsup, ceza infaz kurumundaki infaz süresini etkileyen bir müessesedir. Çalışmada, bu meseleye ilişkin çözüm önerileri açıklanmıştır.

Offset is that lowering the times of restricting liberty which has occured before definitive judgment, from ruled penalty. Arrest is a protection measure which causes to offset because of its property of restricting liberty. In Turkish Penal Code No. 5237, suspension of prison sentence is arranged as a special form of execution of punishment. Accordingly with the decision of suspension of prison sentence, prison sentence which is ruled, is executed in the society. For this reason, together implementing forms of the arrest, offset and suspension occures as an important issue which must be solved. Because, although with the decision of suspension of prison sentence, prison sentence which is ruled, is executed in society, offset is an institute which affects the execution time in prison. In this work, solutions which are about this issue, are explained.
