2/351 Numaralı İstanbul Bâb Mahkemesi Sicilinin Transkripsiyon ve Değerlendirmesi (H. 1231 - 1232- /M.1816-1817)

Abstract

Osmanlı hukukunun en önemli belgeleri olan ve Şer‘iyye Mahkemelerinde alınan kararların suretlerini ihtiva eden Şe‘riyye sicilleri, yaklaşık beş yüz yıllık bir dönemin hukukî, sosyal, İktisadî ve siyasi yapısını, safha safha göstermektedir. Bu yüzden incelenmesi gereken en önemli ve güvenilir belgelerdir. Araştırma konumuz olan 1231/1232H. (M. 1816-1817) tarihli İstanbul Bâb Mahkemesi Sicilli de bunlardan bir tanesidir. Bu sicil üzerinde yaptığımız çalışmanın giriş kısmında Şer‘iyye Mahkemeleri ve bu mahkemelerde tutulan Şer‘iyye sicilleri hakkında, bilgi verilmiştir. Ardından sicillin türü, ait olduğu mahkemenin tanıtımı, sicillin tavsîfi ve sicillin içindeki hükümlerin gruplandırmaya tabi tutularak ayrı ayrı başlıklar altında değerlendirilmesi yeralır. Tarihî metin çalışmalarında esas, metnin en doğru biçimde verilmesi olmalıdır. Böylece araştırıcının doğru yorumu yapabilmesi mümkün olur. Bu konu, bu çalışmayı yaparken üzerinde durduğumuz en önemli noktadır. Buradan hareketle kelimelerin okunuşunda metnin yazıldığı devrin imlâsı göz önünde bulundurulmuştur. Özel adlar ve yer adları değişik kaynaklarla karşılaştırılarak kontrol edilmiştir.

The Transcription of the text of Sicilli dated 1231/1232 H. (A.D. 1816-1817) of the Bâb Court of Istanbul. Şeriyye sicill’s which contain copies of the judgements passed in Şeriyye Court's and which are the most important documents of the Ottoman Judicial System exhibit stage by stage, judicial, social, economical and political structure of a period encompassing approxsimately five hundred years. For this reason, they are the most important and reliable documents to be researched on. Our subject matter, sicilli dated 1231/1232 H. (1816-1817) of Istanbul Bab Court is one of those documents. In the introduction of our study on this sicili, necessary information about Şeriyye Courts and the Şeriyye Sicills which were kept in them are given. Next to it, the sort of sicili, the description of the court to which it belonged, description of sicili and its evalvation, under different headings of the judgements in groups take place. The basis in the studies of historical texts, must be to obtain the most reliable reading. In this way, the best interpretation of its content by the researcher could be possible. This point, is the most important issue on which I studied earnestly. While doing this, I paid special attention to the orthographical rules of the period concerned. I also compaired propernames with various different sources.
